When a tenant dies, issues arise related to obtaining possession of the apartment. Legal rights accrue to the Tenant’s Estate. Generally, the Estate may occupy the premises until the lease expires. This right is intended to allow the Estate Representative to “wind-up” the Estate’s affairs. The Estate generally remains liable for rents that accrue during the term. At the end of the lease the Estate is generally not entitled to renew the lease. Where a tenant dies intestate, that is without a will, it may be necessary to have the Public Administrator appointed.
