Tenants have a Constitutional right to have their case tried before a jury. Jury waiver clauses are standard in leases and are enforceable. The party moving to strike the jury demand has the burden of showing that the jury waiver was made knowingly, intelligently, voluntarily, and intentionally. Under CPLR 4544, a jury waiver provision with a font that is below a certain size, or is illegible, may not be enforced. A jury waiver provision in a lease will be enforced, even after the expiration of the lease.
